Consell de Formentera calls for withdrawal of draft amendment to Coastal Authority's general regulations

foto 2022 CostesToday Ana Juan, President of the Consell de Formentera, sat down with Maria Jose Mayans, Chair of the Platform for Individuals Affected by Delimitation (Plataforma d'Afectats per la Delimitació, PAD), and PAD Spokesman Vicent Tur, to review the local government's representations to the Ministry of Ecological Transition and Demographic Challenge about proposed changes to Coastal Authority regulations, including a request that the proposal be scrapped. An order signed 7 January by President Juan detailed these representations and maintained that the amendment submitted for public consultation was "unlawful and contrary to the case law on delimitations" and "creates legal uncertainty which encroaches on the rights of individuals".

The President stressed that the new regulations must take into account "the peculiarity of Formentera" and that "no backward steps can be taken in this regard". "The people of Formentera have always worked together on this issue and transcended partisanship to defend each others' interests; the new regulations must not increase insecurity or impinge on our powers as a local authority", said Juan, who stressed "the great work of department staff" in preparing the representations.

The document sent by the Consell highlights how the proposed modifications would mark a return "to arbitrariness in determining the scope of public domain" and encroaches on municipal government's authority in town planning and activities. For example, it regulates construction that can be carried out in protected areas and modifies articles that regard conservation works on properties left in the public maritime land domain. "Care must be taken so that these changes don't lead to built structures in this coastal area being demolished earlier than previously accorded", the text reads, highlighting the amendments' potential "to cause significant impact on the landscape and environment".

The modifications would additionally cause "unjustified limitation of the rights of individuals insofar as the changes, in their laxness, leave review of demarcation to the subjectiveness of the Administration, and once again ignore technical criteria accepted by jurisprudence". In addition, the changes may raise "new obstacles to owners' and others' rights in the public land maritime domain".

Absent from the proposed regulations is the section which currently allows individuals to park and drive in the area in question. "In any case, the change stands to create significant environmental concerns and complications in how access to beaches is managed by regional and local authorities, even engendering problems in town planning".

One of the proposed modifications involves limiting concessions to a duration of 30 years, or up to 75 years if renewed, as set out in legislation on "public administration patrimony", which creates provisions for a generic period of 75 years.

Nor does the proposed regulation include an economic impact study, or equivalent mechanisms, which the Formentera government's representations describe as "a fundamental requirement in state legislation" and necessary for the economic quantification of the proposed measures' impact.

Casal de Joves starts year with activities to ignite creativity and assorted other programming

foto 2022 casal felic any nouThe Formentera Office of Youth is pleased to announce the activities scheduled this January at the drop-in centre for young islanders. The programme kicked off 4 January with a hot cocoa party, or xocolatada, before picking up four days later with a spin art workshop and a bracelet making workshop on Wednesday the 12th.

The following activities are forthcoming this month:

Friday 14 January, 6.30pm, Casal de Joves, soap bubbles workshop.

Saturday 15 January, 6.30pm, Casal de Joves, farewell to the Christmas holidays (packing up decorations).

Wednesday 19 January and Wednesday 25 January, screenings of films and documentaries on topics picked by youth.

Friday 21 January, 6.30pm, Casal de Joves, table football tournament for children 10 and up.

Saturday 22 January, 5.30pm, Casal de Joves, coloured salt workshop for children 10 and up.

Friday 28 January, 6.30pm, Casal de Joves, creative nails workshop.

Saturday 29 January, 6.30pm, Casal de Joves, workshop painting doves of peace. These activities tie into the School Day of Non-Violence and Peace on 30 January. As Vanessa Parellada, Councillor of Youth, explained, "Every month, we propose activities related to the interests of young people at the Casal. This month we spotlight creativity, critical thinking and solidarity – one of the focal points of the Peace Day activity".

All activities are in line with current COVID-19 regulations.

Consell recruits 3 more unemployed islanders through 2021 SOIB Reactiva programme

foto 2022 soib 3 personesToday Ana Juan, the President and Councillor of Entrepreneurship of the Consell de Formentera, welcomed three more new hires from the first round of recruitment under SOIB Reactiva. The individuals will work for the island's government for the next six months. Two women will work as administrative assistants and one man will work as a brigade operator.

Plans are also in place for a second round of recruitment, which will include selection of three additional recruits. 2021 SOIB Reactiva has been promoted by the Occupational Service of the Balearic Islands (Servei d'Ocupació de les Illes Balears, SOIB) and co-financed by the European Social Fund as part of the 2014-2020 Youth Employment and Regional Operational Programmes and State funds through the Sectorial Conference of Employment and Labour Affairs.

Consell d'Entitats kicks off discussion of formentera.eco scheme to count and cap vehicles brought on island

foto 2022 CdE 1At 8.00pm yesterday, representatives of local entities and associations gathered for a meeting of the Formentera Consell d'Entitats (CdE) that was focused on taking stock of the 2021 results of formentera.eco, a scheme to regulate the number of vehicles brought and driven on the island, and reviewing a proposal to carry the project forward in 2022. At the end of the first session, CdE members received a copy of the proposal and were asked to share it with their respective associates. On Tuesday 18 January, the CdE will reconvene for a second session to gather member groups' feedback and vote on the proposal.
 
In light of restrictions stemming from tier 3 public health alert, participants were asked to join the gathering online. In-person attendees included Ana Juan, President of the Consell de Formentera; Rafael González, Councillor of Mobility, and Vanessa Parellada, Councillor of Citizen Participation, as well as the secretary of the gathering and the department specialist of the Formentera Office of Citizen Participation. Members of associations, political parties and the local cabinet were able to follow the event online. A total of twenty individuals logged in.
 
President Juan traced the scheme to count and cap vehicles brought and driven on Formentera to a popular request gathered by the CdE and to collaboration between local and regional government aimed at creating legislation for "a more sustainable brand of mobility for Formentera". In that connection, the President said it was in 2019, when formentera.eco first launched, that local legislators set the scheme's current goal of 16% fewer vehicles on the island, shrinking annually by 4% until reaching the desired total.

Today, despite the pandemic, "it is plain to see that regulation is necessary", Juan asserted. As for the first CdE session, Juan signalled it would "serve to take stock of regulation in summer 2020 and to explain the proposed fees and regulatory timeline which will come up for a vote in next week's session".
 
formentera.eco in 2021

The Councillor of Mobility reported on formentera.eco in 2021, during which time a daily limit of 20,591 vehicles was in effect. "Not once was that ceiling surpassed, which means that we made good on one of our regulatory goals", said González, "but the drop in vehicles failed to make a difference in islanders' sense of saturation on the road in August".
 
During the 24 days from 4 to 27 August, visiting motorists accounted for 90% of the allotted vehicle quota. And, for five days during the same month (14-16 and 19-20 August), the quota was reached.
 
Summer 2021 data

Of particular note last season was visiting motorists' shorter-than-average stay of between three and four days. Moreover, 40% of bookings by visiting drivers were for just one day. Sensor and survey data additionally indicate another noteworthy feature: an increase in overall vehicle trips. While in 2019 the average visitor took two trips a day, in 2021 the daily average was 2.9.

Other 2019 and 2021 comparisons

Seventy percent more cyclists were observed on the island's network of nature trails (rutes verdes).
There was a 28% drop in individuals riding public buses.
Rides in taxis increased by 8%.
Daily traffic equalled that of 2019, when an 8% drop had been observed compared to 2017. However, rush hour traffic was up 11%.
 
Based on the data, Councillor González concluded that "regulation has driven a significant increase in bicycle and taxi use, but with the pandemic, people don't feel as safe as they once did on buses, so ridership is down". The pandemic also meant shorter stays and an increase in daily visitor trips. By González's lights, "this caused crowding on roads and, according to islanders, the feeling that there was a large number of vehicles". In that regard, Gonzalez identified imperatives like "continuing to lower the vehicle ceiling", "dissuading visitors from coming just one day" and "stepping up controls".

Consell d'Entitats members will review the following proposal:
Lower the 2019 ceiling by an additional 4%.
2020: - 4 %
2021: - 8 %
2022: - 12 %
2023: -16 % (legislative term target)
In 2022, the vehicle ceiling will be set at 19,696 – dropping under twenty thousand for the first time.

Discussion of regulatory timeline and fees

The CdE session included discussion of the 2022 calendar of regulatory enforcement and fees. Association representatives will consult with their associates and a vote will be taken next week at the second session.

Timeline:
Option 1: 15 June to 15 September.
Option 2: Last week in June to first week in September (as in 2021).

Fees:
Option 1: treble current fees (passenger cars: €3/day [minimum payment: €15]; motorcycles: €1.50/day [minimum payment: €7.50]).
Option 2: double current fees (passenger cars: €2/day [minimum payment: €10]; motorcycles: €1/day [minimum payment: €5]).

2022 bookings

The summer 2022 bookings website will come online in the second half of February. The current rate of €1/day for cars (minimum: €5) and €0.50/day for motorcycles and mopeds (minimum: €2.50) will be applied until a modified rate is adopted in April or May. Accreditation will be free for residents of Formentera and the Balearic Islands and individuals with electric vehicles.

Until the bookings website goes online, all accommodation and ferry reservations will guarantee accreditation for reservation holders.
 
Sustainable mobility
 
Councillor González described the end-game of formentera.eco as "achieving an island where mobility is sustainable and where pedestrians, bicycles and riders of public transport enjoy increased prevalence to the detriment of private vehicles".
 
In 2022, €270,000 will be allocated to restore the public bus service to pre-pandemic levels and recover 28% of the riders lost in 2021. Likewise, the service will remain free of charge for residents and visitors under 18 and for residents and visitors with disabilities and their companions.
 
Councillor Gonzalez announced an agreement with the local chauffeurs' association that 49 taxis (25 ordinary and 24 seasonal permits) would provide summer service in 2022 and 2023 for a 29% increase relative to summer 2021, when 38 taxis (25 ordinary and 13 seasonal permits) were in circulation.
 
Other pre-season efforts will include encouraging pedestrians and cyclists to use the Camí des Brolls path linking La Savina, Sant Francesc and Es Pujols and closing traffic to motor vehicles, except for area residents. In addition, residents will continue to receive assistance to purchase traditional and electric bicycles.
 
Reinforced controls and new information drives

Lastly, Councillor González highlighted plans to bolster control systems. The island currently has cameras in place in La Savina and a mobile camera. In 2022, cameras will be installed at the hospital roundabout; attendants will also monitor parked vehicles, and drivers of rental cars must display information about their rental contract when they park in La Savina.

Before regulatory enforcement resumes, to ensure that all motorists, whether island residents or not, possess the authorisation to drive and park their vehicles on local roads, in May the Consell will lead an educational push tailored for this purpose.

As Formentera enters tier 3 of public health alert, COVID certificate to be required in restaurants, cultural establishments and indoor sports facilities

foto 2022 nivell 3Today Ana Juan, President of the Consell de Formentera announced in a press conference that the island has entered tier 3 of public health alert  the same as the rest of the Balearic Islands. Endorsed by the Government Council, the change will take effect today on publication of one-off edition of the Official Gazette of the Balearic Islands (Butlletí Oficial de les Illes Balears, BOIB).

Among the chief features of tier 3, COVID certificates must now be presented inside all bars, cafeterias and restaurants, as well as for indoor cultural and sporting events like the cinema, swimming pool and the fitness centre.

President Juan stressed that in the last fortnight, Formentera's case count had "increased exponentially". Faced with these data, she said, "it is necessary to expand protective measures on the island". Juan asserted that "while the vast majority of cases are mild or asymptomatic, today four Formentera residents are in the ICU for COVID-19". The President pointed to the primacy of vaccination in stopping the pandemic and insisted that measures like the COVID certificate and self-tracing help further reduce spread of the virus. "We must continue to be responsible, and not let our guard down with protection, hygiene and ventilation".

Municipal sports schools and Festival of Children's Entertainment cancelled

The President also pointed out that the island has closed municipal sports schools until 17 January and cancelled the Festival of Children's Entertainment originally scheduled for this weekend. "Children are once again heading back to the classroom, and as much as possible, we intend to adhere to bubble groups. Since the start of the pandemic, classrooms have been safe places and we want to keep them that way", said Juan, who apologised for any inconvenience the postponements may cause. The cancellation of sports schools was done in collaboration with local clubs and next week the situation will be re-evaluated. Likewise, tomorrow's gathering of the Consell d'Entitats, where members were set to address measures to regulate vehicles brought and driven on the island, will be held online and at the originally scheduled time: 7.30pm for the first group and 8.00pm for the second.

Under tier 3 of public health alert, access requirements apply to the following establishments:

-Gyms and sports facilities.
-Cultural and sporting events in indoor spaces like cinemas, covered circuses, theatres, auditoriums, concert halls, heated pools.
-Seminars, conferences, assemblies, gatherings, business meetings and events.
-Seniors' clubs and spaces where activities are held specifically for the elderly.
-Gaming and betting establishments.
-Restaurants and dining establishments.
-Regional outdoor and indoor sports competitions and training for people aged 12 and up.
